GOVERNMENTAL AGREEMENT No. 270-2013




EXECUTIVE BRANCH

The Presidency of the Republic

              Agrees to declare the process, promotion, construction and operation of the project
              known as CORREDOR INTEROCEÁNICO DE GUATEMALA to be of PUBLIC
              BENEFIT and NATIONAL INTEREST.

THE PRESIDENT OF THE REPUBLIC
WHEREAS


      That the Political Constitution of the Republic of Guatemala, establishes that it is an
      obligation of the state to orient the national economy to achieve the use of natural
      resources and human potential, in order to increase the wealth and try to reach full
      employment and equitable distribution of the national income. In addition, establish that it
      is an obligation of the State to adopt the measures that are seen as necessary for the
      conservation, development and the efficient use of natural resources.

WHEREAS

          That the Political Constitution of the Republic establishes that due to the economic
           importance in the development of the country, recognized the public benefit, and
           therefore,
commercial and tourist transportation enjoy the protection of the State, whether it is on
land, by sea or by air, among which we include ships, vehicles, facilities and services.

WHEREAS

That the interested municipalities have issued Municipal Agreements declaring the project
known as “Inter Oceanic Corridor of Guatemala” of public benefit and municipal interest,
which will allow the country a strategic positioning before world trade, foreign investment,
employment generation and revenue income, as well as improving the quality of life and
holistic development of all inhabitants of the Republic of Guatemala.

THEREFORE

In the exercise of the functions conferred by Article 183 clause e) of the Political
Constitution of the Republic, and based on the established in articles 118, 119, 131 and
195 of the Political Constitution of the Republic of Guatemala; and 4, 5, 16 and 17 of the
Executive Branch Law.

IN COUNCIL OF MINISTERS
AGREES

Article 1. Public benefit and national interest. The process, promotion, construction and
operation of the project known as “Inter Oceanic Corridor of Guatemala” is of PUBLIC BENEFIT and NATIONAL INTEREST, considering that this project will give the country a strategic advantage before global trade, attract foreign investment, generate direct employment and greater income for the state, in concept of revenue; as well as improve the quality of life and holistic development of all inhabitants of the Republic of Guatemala and which represents a change of paradigm for the economic development model whentransforming “host communities” into “associate communities” those communities are directly impacted by a private entrepreneurial endeavor, oriented toward the consecution of the common good. This Inter Oceanic Corridor consists of a band of land, as private property, of approximately three hundred seventy-two kilometers (372 kms) long by one hundred forty (140) meters wide that will connect the Atlantic and Pacific Oceans of Guatemala and in which two port terminals will be built with the latest technology, a railroad for the transfer of inter oceanic containers, logistical activity zones, for transportation of hydrocarbons and its derivatives, a highway, transportation services for
the Electric Company, Telecommunications and others that agree with the design plans and trace the routes.

Article 2. Protection of the State. The State of Guatemala can grant the necessary protection for the development and execution of the “Inter Oceanic Corridor of Guatemala”, through the issuance of laws, regulations, agreements or resolutions, as well as any other disposition of internal order that would be proceeding to provide certainty and juridical security and that will allow reaching its fundamental objectives, among them, being a development instrument for Guatemala.

Article 3. Investment Protection. In the protection framework that the State of Guatemala can grant derived from this Agreement, all national and international investments held or to be held that are declared of public benefit and national interest, in this case the “Inter Oceanic Corridor of Guatemala” during its development and execution will enjoy, without prejudice, the protection that the Law of Foreign Investment and Investment Protection Agreements subscribed and ratified by Guatemala grant.

Article 4. Internal dispositions, tutelage and support. The administrative authorities o the Executive Branch or that hierarchically depend on the Presidency of the Republic, can issue the agreements, resolutions and/or dispositions of internal order necessary and that are proceeding, for the process, promotion, construction and operation of the “Inter Oceanic Corridor of Guatemala”, and in addition, must oversee its effective compliance, offering the necessary cooperation when required, for the adequate development of the project.

Article 5. Legal Documentation. For the execution of the project known as “Inter Oceanic Corridor of Guatemala”, the contractors must previously request and obtain the licenses, studies and authorizations from the corresponding authorities, according to current legislation.

Article 6. Easements. On the real estate that would be affected directly by the construction of the works contained in the project known as the “Inter Oceanic Corridor of Guatemala”, that belongs to individuals, easements will be written up, as they correspond according to the law on such matters.

Article 7. Validity. This Agreement will begin to be enforced the day after it is published in
the Diario de Centro América.

鉴于

依据危地马拉宪法,国家有责任通过对自然和人力资源的利用,引导国家经济实现财富的增长,努力达到充分的就业率和国民收入的合理分配。同时,国家还有义务采用必要的措施,确保自然资源的保护、开发和有效利用。

鉴于

鉴于共和国宪法确立了经济在国家发展和公用设施确立中的重要性,因此所有商业运输服务和旅游,包括陆地、海洋或航空,其中对应的船舶、车辆、设施和服务等都应得到国家的保护。

鉴于

相关市政当局已发布“危地马拉跨海洋走廊”项目市政协议声明,使政府处于可应对国际贸易、外资、创造就业机会和税收以及危地马拉共和国居民生活质量改善和居民发展的战略地位。

因此

根据共和国宪法第E部分第183条赋予的职能,在危地马拉宪法第118119131195条及其执行法案第451617条的基础上。

 

内阁会议批准以下协议

第一条。公用事业和国家利益计划。宣布名为“危地马拉跨洋走廊”项目的管理、推进、建设和运行公共事业和国家利益计划。这是一项使国家在世界贸易领域赢得一个战略的位置、可吸引外资、创造就业机会和提高国家税收;使危地马拉共和国国民生活质量得到改善和发展。 它代表了经济发展模式通过民营企业的直接影响,从“主体经济模式”向“合作经济模式”转变,实现利益共同化。该跨洋走廊包括一条大约为三百七十二千米(372千米),宽超过一百四十米(140米)的私有制土地,链接危地马拉的大西洋及太平洋海岸,根据设计图纸的要求,会在每个海岸修建两个新一代的码头、一条集装箱中转铁路、一个物流中心、一条用于运输碳氢化合物及衍生物的管道、一条公路,还有电力、电信输送服务以及相关的设施。

第二条。国家保护。 危地马拉政府应通过发布法律法规、协定或办法,以及任何能够为其实现基本目标提供法律确定性和安全性的内部部署,为“危地马拉跨洋走廊”项目的开发和执行提供保护,作为实现危地马拉发展的工具。

第三条 投资保护。在本协议下提出危地马拉政府为公用事业和国家利益提供保护框架,已有的或以发展和执行“危地马拉跨洋走廊”项目为目的国家或国际投资都受到外商投资法和危地马拉签署与批准的投资保护协定的保护。

第四条 内部部署、监护和支持。执行机构或共和国总统下属行政当局可以发布关于即将进行的“危地马拉跨洋走廊必要的协议、决议和/或内部部署,另外,应确保其有效符合规定,在需要时为项目的适当发展提供相关合作。

第五条 法律文件。用于要执行“危地马拉跨洋走廊”项目,承包商必须提前按照当前法规申请并获得执照、研究许可和有关当局的授权。

第六条 地役权。所有私人土地房产直接受到危地马拉跨洋走廊项目施工影响的,可适用法律中的地役权。

第七条 有效性。本协议在其刊登于中美洲日报之日起生效。
